Terms of Service

These terms govern your access to and use of the Pro Recruit website and our recruitment services for companies and job seekers across India.

In short: By using our site or services, you agree to these terms. We provide recruitment services — we are not your employer. Companies pay success-based fees as agreed in writing; candidates use our services free of charge. Use the site lawfully and provide accurate information.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Pro Recruit Talent Solutions ("Pro Recruit", "we", "us", or "our") governing access to our website and use of our recruitment and talent-acquisition services.

By accessing our website, submitting a form, registering as a candidate, applying for a job listing, or engaging us as a hiring partner, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

If you enter into a separate written agreement with us (such as a master services agreement or placement terms), that agreement will prevail over these Terms to the extent of any conflict regarding the subject matter of that agreement.

2. Our Services

Pro Recruit is a recruitment agency based in Mumbai, serving companies across India. Our services include, without limitation:

  • Permanent hiring — full-time placements across junior, mid, senior, and leadership levels;
  • Volume hiring — structured bulk recruitment drives;
  • Specialized talent search — niche or hard-to-fill roles;
  • Executive search — confidential searches for senior leadership, including reference checks where agreed;
  • Candidate services — job listings, resume registration, and matching with client opportunities.

We act as an intermediary between employers and candidates. We are not the employer of candidates we introduce, and we do not guarantee that any role will be filled, any candidate will be hired, or any particular outcome will be achieved.

3. Eligibility

To use our website and services, you must:

  • Be at least 18 years of age and legally able to enter into binding contracts under Indian law;
  • Provide accurate and complete information when requested;
  • Not be barred from using our services under applicable law.

Companies must have authority to bind their organization when submitting hiring requirements or entering commercial arrangements with us.

4. Use of the Website

You agree to use our website only for lawful purposes and in accordance with these Terms. You must not:

  • Submit false, misleading, or fraudulent information or documents (including resumes or job postings);
  • Impersonate any person or entity, or misrepresent your affiliation;
  • Scrape, crawl, or harvest data from the site without our prior written consent;
  • Attempt to gain unauthorized access to our systems, accounts, or networks;
  • Upload malware, spam, or harmful code;
  • Use the site to harass, discriminate against, or harm others;
  • Circumvent fees or commercial terms by contacting candidates or clients introduced by us outside agreed channels during an active engagement, where such restrictions are set out in your client agreement.

We may suspend or restrict access to the website at our discretion if we believe these Terms have been violated.

5. For Companies (Clients)

If you engage Pro Recruit to hire talent:

  • You will provide accurate job descriptions, compensation guidance, and hiring timelines;
  • You are responsible for your own employment decisions, interviews, background checks (beyond any agreed executive search steps), offer letters, and compliance with labour and employment laws;
  • Fees, payment terms, replacement guarantees, and exclusivity (if any) will be as set out in your proposal, order form, or written agreement — typically on a success-based basis (fees due when a candidate joins, unless otherwise agreed);
  • You will not solicit or hire candidates we present outside agreed terms during the protection period specified in your contract;
  • You will treat candidate information received through us as confidential and use it only for recruitment purposes.

Submitting a hiring requirement via our For Companies page or contact form does not create a binding contract until we confirm engagement in writing.

6. For Candidates (Job Seekers)

If you register with Pro Recruit or apply for roles:

  • Our services are free of charge to candidates — we do not charge job seekers placement fees;
  • You represent that information in your resume and applications is truthful and that you have the right to share it with us;
  • You consent to us sharing your profile with prospective employers for relevant opportunities, as described in our Privacy Policy;
  • We may contact you about suitable roles by email or phone; you may opt out of non-essential communications where applicable;
  • We do not guarantee interviews, offers, or employment. Hiring decisions rest solely with the employer;
  • Active profiles are typically retained for six (6) months unless renewed or deleted upon request.

Applying for a job or submitting your resume does not create an employment relationship between you and Pro Recruit.

7. Fees & Payment

Candidates: No fees are charged to job seekers for standard registration, resume submission, or application through our platform.

Client companies: Fees are charged only as agreed in writing for successful placements or other services (e.g. retained search). Unless otherwise stated, our model is "no placement, no fee" for success-based assignments. Invoices are payable within the period stated on the invoice. Late payment may attract interest or suspension of services as permitted by law and your agreement.

All fees are exclusive of applicable taxes (such as GST) unless stated otherwise.

8. Intellectual Property

The Pro Recruit name, logo, website design, text, graphics, and other content on this site are owned by or licensed to us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except for personal, non-commercial viewing or sharing of job listings with appropriate attribution.

You retain ownership of content you submit (such as your resume). You grant us a non-exclusive, royalty-free licence to use, store, reproduce, and share that content for recruitment purposes as described in our Privacy Policy.

9. User Submissions

Information submitted through contact forms, hiring inquiries, resume uploads, and job applications must be accurate and must not infringe third-party rights. We may remove content or reject submissions that violate these Terms or applicable law.

Form submissions on this website may be processed for demonstration or operational purposes. Where a form is not yet connected to a live backend, submission may be handled client-side only — we will indicate material changes to form handling in an updated Privacy Policy or site notice.

10. Confidentiality

Each party agrees to keep confidential non-public information received from the other in connection with recruitment services, except where disclosure is required by law or to professional advisers bound by confidentiality. Client hiring plans and candidate personal data must be handled in accordance with applicable law and our Privacy Policy.

11. Disclaimers

Our website and services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the above, we do not warrant that:

  • The website will be uninterrupted, error-free, or secure;
  • Job listings are current, accurate, or still available;
  • Any candidate or role is suitable for your needs;
  • Information provided by third parties (including employers or applicants) is complete or accurate.

You use the website and rely on our services at your own risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Pro Recruit and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from or related to these Terms or our services.

Our aggregate liability for any claim arising out of or relating to these Terms or our services shall not exceed the greater of (a) the fees paid by you to us in the twelve (12) months preceding the claim, or (b) INR 10,000, except where liability cannot be limited under applicable law (including fraud or wilful misconduct).

13. Indemnification

You agree to indemnify and hold harmless Pro Recruit from claims, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, inaccurate information you provide, or your violation of any law or third-party rights.

14. Termination

We may terminate or suspend your access to the website or services at any time, with or without notice, for conduct we believe violates these Terms or is harmful to other users, clients, or our business.

You may stop using our services at any time. Candidate profile deletion requests may be sent to jobs@prorecruit.in. Provisions that by nature should survive termination (including confidentiality, liability limits, indemnity, and governing law) will survive.

15. Governing Law & Disputes

These Terms are governed by the laws of India. Subject to mandatory consumer protections, courts in Mumbai, Maharashtra shall have exclusive jurisdiction over disputes arising from or relating to these Terms or our services.

Before initiating formal proceedings, parties agree to attempt good-faith resolution by contacting hello@prorecruit.in within thirty (30) days of the dispute arising.

16. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date reflects the latest version. Continued use of the website or services after changes constitutes acceptance of the revised Terms, subject to applicable law. We encourage you to review this page periodically.
